ByteDisk ("we," "us," or "our") respects the intellectual property rights of others. You may not infringe the copyright, trademark, or other proprietary informational rights of any party. We may, in our sole discretion, remove any content that we have reason to believe violates the intellectual property rights of others and may terminate your use of the Website if you submit such content.

Although ByteDisk is not necessarily subject to United States law in every jurisdiction where it operates, we voluntarily follow the notice-and-takedown principles of the Digital Millennium Copyright Act, Title 17, Section 512 of the United States Code ("DMCA"). We respond to effective notices of claimed copyright infringement sent to our designated copyright agent.

1. Repeat Infringer Policy

As part of our repeat-infringement policy, any user for whose material we receive three good-faith and effective copyright complaints within any contiguous six-month period may have their grant of use of the Website terminated. We may also remove or disable access to allegedly infringing material and restrict, suspend, or terminate accounts in other appropriate circumstances.

2. ByteDisk's Approach to Content

1.1 No Automatic Indexing

ByteDisk is technically unable to automatically index or pre-screen the content being uploaded or stored on its servers. Content moderation occurs only in response to user uploads and copyright notices.

1.2 Content Privacy

ByteDisk considers uploaded content to be private and confidential unless the user has made it public or shared it. We do not monitor or review content unless notified of a potential violation.

1.3 No Authority to Judge Content

Without a distinct copyright owner's notification or legal authority, ByteDisk has no authority to make judgments on whether each user is competent to upload content (e.g., whether such user is the copyright owner, authorized proxy of the owner, whether the content is uploaded for personal use, whether the copyright has expired, or if the content qualifies as fair use). Any content is considered consistent with our Terms of Service unless otherwise notified by the copyright owner or authorized person.

3. Filing a Copyright or DMCA Notice

If you believe that any material on ByteDisk infringes upon a copyright you own or control, you may file a copyright notice with our designated agent. Notifications should be emailed to: dmca@bytedisk.net. Notices that are not relevant to ByteDisk or are ineffective under applicable law may receive no response or action.

2.1 Required Information

Pursuant to Title 17, Section 512(c)(3) of the United States Code, an effective notice of claimed infringement should include substantially the following:

1. Identification of the copyrighted work: Describe the copyrighted work believed to be infringed and, where possible, include a copy or the location (for example, a URL) of an authorized version of the work.
2. Identification of the allegedly infringing material: Describe the material and provide the specific ByteDisk URL or other information that allows us to locate it on the Website.
3. Contact information: Provide information that allows us to contact you, including your address, telephone number, and, if available, your email address.
4. Good faith statement: State that you have a good faith belief that use of the material complained of is not authorized by you, your agent, or the law.
5. Accuracy and authority statement: State that the information in the notification is accurate and, under penalty of perjury, that you are the owner or are authorized to act on behalf of the owner of the work that is allegedly infringed.
6. Signature: Provide a physical or electronic signature from the copyright holder or an authorized representative.

2.2 How to Submit a DMCA Notice

Note: Messages, including DMCA notices, are accepted as plain text. Attachments are not opened due to security reasons and will only be processed if requested by us.

4. Notice and Takedown Procedure

Upon receiving a valid DMCA Notice from our Designated Agent, or when ByteDisk becomes otherwise aware that copyright rights are infringed, we will:

1. Remove or disable access to the allegedly infringing material as soon as possible (generally within 24-48 hours of receipt of a valid notice).
2. Notify the user whose content was removed, providing information about the notice and the opportunity to file a counter-notice.
3. Preserve evidence and information that may be relevant to the dispute.

5. Counter-Notification

If you believe your content was removed in error, you may file a counter-notification with our Designated Agent. Your counter-notification must include:

1. Your name, address, phone number, and email address.
2. The URL(s) of the removed content.
3. A statement that you have a good faith belief that the content was removed in error.
4. A statement that you consent to jurisdiction of the federal court in your judicial district (or if you are outside the U.S., that you consent to jurisdiction of any U.S. federal court).
5. Your physical or electronic signature.

Upon receipt of a valid counter-notification, ByteDisk will provide it to the original claimant. If the claimant does not notify us within 10 business days that they have filed a lawsuit seeking an injunction against you, we will restore the content.

6. Additional Repeat Infringer Enforcement

ByteDisk may terminate accounts of users who are determined to be repeat copyright infringers. We will exercise this right in our sole discretion and in circumstances we deem appropriate, including the three-effective-complaint threshold described above.

7. Child Safety

ByteDisk does not tolerate child sexual abuse material (CSAM) or any content involving the exploitation or abuse of minors. If you discover such content on ByteDisk:

1. Do not download, share, or engage with the content.
2. Report it immediately to contact@bytedisk.net with the specific URL(s).
3. Also report it to the National Center for Missing & Exploited Children (NCMEC) at CyberTipline.org.

Upon notification, ByteDisk will immediately:

• Remove the content and disable access.
• Terminate the account of the user who uploaded the material.
• Report the matter to law enforcement and appropriate child protection authorities.
• Preserve all evidence for investigation.

10. Changes to This Policy

ByteDisk reserves the right to update this DMCA Policy at any time. Changes will be effective upon posting to this page. Your continued use of ByteDisk after any changes constitutes your acceptance of the updated policy.
